Tenants need to be aware that local authorities operate 'secure tenancies'
and the majority of housing associations operate 'assured tenancies'
and may find, therefore, that the conditions of their tenancy may alter
slightly as a result of an exchange between housing association and
local authority properties.
Mutual tenancy exchanges are not permitted for assured shorthold tenancies.
Wherever possible, Axiom will assist tenants in securing satisfactory
tenancy exchanges.
The following conditions apply:
- There must be no rent arrears or an agreement must be made to clear
arrears.
- The exchange must not result in under-occupation or overcrowding.
- When a tenant requests a mutual exchange Axiom will issue two application
forms, one of which must be completed by our tenant and the other
by the incoming tenant.
- Axiom will make enquiries with the other housing organisations
involved to ensure there are no reasons that would prevent the exchange
from proceeding.
- When the two application forms have been received, we will contact
our tenant to arrange an end of tenancy inspection.
- The inspection will check the condition of the landlord's fixtures
and fittings, any adaptations to the property and number of keys
to the property.
- A tenancy report letter is sent to the other landlord giving a
date of exchange.
- A letter is sent to the incoming tenant giving details of the rent
and the date and time of handover.
- A letter is sent to the outgoing tenant giving details of any outstanding
rent together with the date and time of handover.
- Both the incoming and outgoing tenants need to be present to sign
Assignment of Tenancy forms and the incoming tenant needs to sign
a Licence to Assign Tenancy form.
